06.06.2008 : The next fatc of tortures was revealed by human rights activist in Issykkul oblast

On June, 2nd, 2008
human rights activists of a network « the Voice of Freedom » in Issykkul oblast
kami Ruziev and Ella Matveeva on May, 28th of 2008. spent monitoring of ITM of
Tup RDIA and have revealed the fact of tortures of arrested Nurlan Bajbosunov.
According to Naibosunov, accused of theft of a horse, he was beaten by
employees of militia during carrying out of investigatory actions with the
purpose of reception of  indications and demanding to plead guilty.

Human rights activist have invited for physical examination the surgeon of the
regional center of family medicine Jamilya Omurbekova.  During joint visual
survey they have found out traces of hematomas in the field of the left
shoulder and cuts on the internal side of the left hand. The prisoner
complained on noise and  pain in ears.

Management of DIA of Tup area on a question of legal experts on wrongful actions
of employees of militia has answered that concerning Bajbosunov were not applied
any illegal methods. «These criminals accused of  some thefts and criminal case
was taken away  from us 3 days ago by employees of Department of Internal
Affairs of  Issykkul oblast. Now investigatory actions are spent by the
inspector of Department of Internal Affairs Talip Zhanaliev. We are compelled
to contain accused in ITM with the purpose of prevention of arrangement with
another suspected, containing now in ITM of Karakol and constantly to transport
him on  interrogations in  Karakol », - have answered in RDIA.

This very day activists have addressed to public prosecutor of Tup  area Dayrbek
Oruzbaev on the fact of infringement of the rights of the prisoner and
acceptance of corresponding measures by him. The public prosecutor has promised
to consider  this case and direct forensic expert for medical survey and medical
conclusion. However on May, 29th at a repeated meeting of activists with the
public prosecutor it has appeared, that his  instructions have not been
executed. Already at presence of activist  Ruziev the public prosecutor has
demanded immediately to follow his instruction  on carrying out of examination
of the prisoner.

On May, 30th forensic expert of Tup area Esen Tontortov at a meeting with Ruziev
has confirmed, that he examined the prisoner and found  traces of beatings.
However till now law enforcement bodies of area have not born  the decision on
carrying out of examination and are not going to open investigation.  All goes
to taking away from the responsibility the guilty in tortures.

Let's remind, that in February of this year Kyrgyzstan ratified 2-Optional
protocol  to the Convention of the United Nations against tortures.
Notwithstanding that there is an article in Criminal Code KR about tortures,
none of employees of militia was not called to account.
