Having got in the investigatory insulator in the south of Kyrgyzstan,   it is possible to become pregnant, give birth, bury the child and to be subjected to  tortures.

Conditions of the maintenance of persons  under investigation in insulators of the time maintenance in Kyrgyzstan ,  and also in many other  postSoviet countries leave much to be desired. From numerous stories of the people who have visited these establishments we know about close, dark and crude premises in which, having leant against concrete walls or laying on cold floor, suspected in crimes  wait for the termination of investigation . . But, if to consider, that in an investigatory insulator not always get only criminals,  there is a reasonable question: how much such  treatment  is fair?

 

Exactly in  such  conditions  has lived  22 years old girl whole eight months , and within seven months  she was pregnant. In a maternity hospital  her  brought  directly from an insulator, and in three days after  childbirth, and in 2 days after death of the unfortunate kid , she have again returned in an insulator, on a dirty, cold floor. Do you think, this woman was accused of grave crime?

 

Zulhumor Tuhtanazarova was born in 1980 in village Bazarkorgon of  Osh (nowadays Jalal-Abad  )  region, in country family. Having  finished eight  classes,  she has started to work with parents.

 

In March, 2003, in one of the usual working days, Zulhumor has gone to a field. On road  she was attacked by some guys, they  have raped, have beaten and have disappeared. How  much grieved  her parents,  made noise, the militia "could not" find tyrants. Then, trampled by injustice of employees of law enforcement bodies, deprived of civil rights life of our heroine has begun.

 

"These cursed militiamen have missed villains and have closed  the case, - heart-broken mother  of Zulhumor tells. - Not only that attacked have raped my daughter, they as has appeared, have strongly struck  her on a head. After that  she became the patient mentally. I r went on hospitals and treated  her , but completely  she has not recovered. Began to leave often in a unknown direction and to  disappeared for a long time. Once, she  has come into the hands of prostitutes and thieves ".

 

That day Zulhumor  has appeared in the company of two  persons, earlier convicted  and  prostitute. Their was no enough  money for alcohol, and they have gone " on business ", having taken with themselves and Zulhumor.  Malefactors have stolen linen and the old oriental carpet, hung in a court yard of the multi-storey house. The total cost of things has made  about  25 US dollars.

Employees of a department of Internal Affairs of Bazarkorgon region  have caught pilferers including Zilmuhor on a scene of crime. First of all has been interrogated Zulhumor , who because of the dementia plainly  did not understand, what happened.  

 

" After two-three questions the woman-inspector has started to shout and threaten me ", - has told Zulhumor . According to the girl, the inspector has asked: "Are these things were stolen by you? ". "No, I did not take. They were taken by my friends whom I badly know, - has answered Zulhumor . – These  fellows asked me to keep watch and give a sign if I  shall see someone . I have told about it some times, but the inspector did not listen to me and have started to beat. I have become angry and too have strongly struck  him. After that me  for a long  time beat  bu bludgeons and have closed in an insulator of the time maintenance ".

 

Zulhumor,  got used to humiliations and  beatings since the childhood, and now with pleasure recollects, how  she has struck the inspector. Then the mentally retarded girl did not realize,  what  this impact will turn back for her with.  However the maintenance within eight months in  te insulator of time maintenance is not everything, that have tested on  herself Zulhumor and  her  casual accomplices.

 

"We were tortured and offended every day. They came to us and beat - simply , without any reasons. Me sold for 100  soms  (2,5 US dollars. - a comment of the edition.): let in chambers to men and  let out only in the morning. They humiliated us, speaking thus, that we prostitutes ", - speaks Zulhumor.  

 

Unlike professional prostitutes Zilhumor had no  experience and has soon become pregnant. The 22-years pregnant woman slept in the close, dark and crude chamber, for weeks remained hungry.

 

"Sometimes they did not give me even water, sometimes - bread, - has told Zulhumor  -That brought from the home, often did not transfer in the chamber. Once at me the stomach was ill and the diarrhea has begun. Not having bear , I begged militiamen to give me a medicine. After they have given any tablets, at me strong pains have begun. I did not guess, that it were  birth pangs , and laid, having bent ".

 

After a while the chamber fellows girls have started to shout and call supervisors. Her took directly in a maternity hospital. The child was born alive, however because of weakness the kid was lost for the second day of the short life. In spite of the fact that after heavy childbirth  she was strong became weaker ,on Zulhumor at once have put on handcuffs and have brought back in  the insulator of time maintenance.

 

 Next day the court took place. Zulhumor , gone through  set of painful interrogations for 8 months,  all fault has incured. All accomplices of Zulhumor , even the recidivist who  was in prison  for  twelve years,  were  sentenced  to one year conditionally and have released directly in a hall of court. During proceeding it has not been told words neither about beatings  of Zulhumor,  nor about her lost child,  which has been conceived in an investigatory insulator.

 

 

Mother  of Zulhumor has learned about pregnancy of the daughter only when the young woman has appeared on a couch of a maternity hospital. "To meet the daughter to me have resolved all once, and that I could not talk with her, - mother of  Zulhumor has told. - And then in general have ceased to go in there. Sometimes  brought from  her letters, but they have been written not by her handwriting, and the same words there repeated: " With me all is good, do not worry ". Once I have incurred daughters parcel  and when to me have told, that  she is in a maternity hospital, I nearly have not lost consciousness ".

 

Humiliated and offended, mother and the daughter went on many instances, but anywhere have not found the person who would listen to them. Then they have addressed in the remedial organization "Air" of Bazarkorgon region . The head of organization Azimjan Askarov has went  with Tuhtanazarov all cabinets once again, and it seemed, that he  has managed to achieve any results: two inspectors who beat Zulmuhor and  her friends,  were dismissed, and against four employees of militia have raised criminal cases. " However,  everyone know, how the judicial system works at us,   , - tells Azimjan Askarov. – Cases  of employees of militia considers military court, and it is in the city Osh, in 130 kilometers from our village. Victims,  who hardly make ends meet, could not go to court. And militiamen  were released, having defined conditional punishments ".

It would seem, on it the story should come to the end. However,  later three years,  when misfortune has started to be forgotten, and life of Zulmuhor began to be adjusted,  she was again detained on charge in theft and have thrown in the same insulator of the time maintenance, and tortures on the cruelty have surpassed all previous. "When  she has left an insulator and has come to us to office, we have found out, that to  her under nails entered needles, - has told Azimjan Askarov. - On a body there are traces from strong  beatings. . We have removed all this on video and have kept. Now  both, the family  of Tuhtanazarov’s and we  stand   on our words, try to restore validity up to the end ".

 

Zukmuhor Tuhtanazarova was let out from  the insulator of time maintenance in two days, however,  now  she is accused of larger theft. The investigation is finished and transferred in court. The first session of court on this case took place several days ago, however, then hearings have been transferred for uncertain term without any comments.

 

The public prosecutor of  region Rasulbek Umarov has refused to answer questions on the tortures applied to Tuhtanazarova  in an insulator of the time maintenance.  His assistant Ermamat Kozhoakmatov, having limited to the short answer, that   application of Tuhtanazarov’s is considered, and the official conclusion is not ready yet, has disappeared behind a door of the cabinet.

 

Perhaps, also it is not necessary to count on more? And what, actually, can be reaction of inspectors which humiliated mentally sick, helpless girl?..What  can be expected, when those who should stand on the party of the law, break it?

 

The problem of violence  in  insulators of the time maintenance in Kyrgyzstan is not new. In particular, this question was discussed during a round table "Consolidation of healthy forces of a society on he prevention of tortures" which has passed in January, 2006 within the  frames of republican campaign " Help to stop torture! ". Owing to efforts of legal experts from  the Kyrgyz Committee for Human rights, and deputy Beknazarov, in 2003 in the Criminal code of the country there was an addition to clause 305, providing the responsibility for application of tortures.

 

However ,  there was not any case of punishment under this clause, and prisoners of the insulator of time maintenance , as before, become victims of employees of law enforcement bodies.
