The human rights defenders, at research of incident with beating prisoners of isolator of time maintenance in Djalalabad of a city department of police have revealed, that police men try to hide traces of cruel treatment with arrested peolpe.

In order not to be proofless, we have decided to result below the letter of director of the coordinator regional human rights organizations Valeriy Uleev "Validity", addressed to the public prosecutor of the city of Djalalabad. Whether the public prosecutor will think this time, what actions the clever books named laws are created for? We shall live, and see.

We inform you, that on August 16, 2006, the Commission of Human Rights under the President of KR had been initiated visiting the isolation ward of temporary allowance of the city of Djalalabad OVD. In survey of isolator and conversations with prisoners have taken part: the vice-president of the Commission of Human Rights under the President of KR Aziza Abdirasulova, employees of OSCE on southern region Fabritsio Wielmini and Oktam Gaziev, chairman of Council OPZO » Validity » of Valentine Gritsenko and the employee of the Kirghiz committee under human rights Taalaibek Kamalov.

During the visit, the conversation with Chynarbek Jumaliev who on August 13, 2006 in building of City Department of Internal Affairs tortured 7 employees of UR directly opposite to a cabinet of deputy chief of CDIA. He has named names of these employees: Emil, Talant, Ulan, Daniyar, Nurik, Sabyr and the name of seventh is not known. As a result of application of tortures by Chynarbek has received strong physical injuries. His head was put on a gas mask and periodically closed the valve.

By words of Chynarbek, he 2 times lost consciousness. The purpose of torture was reception of grateful indications against himself.

By the request of Aziza Abdirasulova, chief of CDIA Kubanychbek Torobaev has resulted accompanied by escort Chynarbek Jumaliev in the cabinet where were present except for all members of the commission and chief of CDIA also the deputy the public prosecutor on supervision of Djalalabad Suyun Satibaldiev, assistant of the chief of CDIA Marat Hajimatov, the head of legal reception OPZO "Validity" Baktykan Japarova. All presents saw, that the back of Jumaliev was covered with traces of beatings, on the higher part of hands and on an elbow and on legs - a hematoma. On a neck a hematoma from a hose by the words of Chynarbek oppressed. In the same place members of the commission have made pictures of traces of the beatings.

Chief of CDIA Kubanychbek Torobaev has told, that Chynarbek is accused of fulfilment of some especially dangerous crimes.

Members of the commission here in a room have solved the problem on attraction of the independent lawyer from Osh for protection of Chynarbek Jumaliev.

But, when on August 17 there has arrived the lawyer Chydyev Nurdin Borubaevich, appeared, that Chynarbek the preventive punishment is changed, he is released on a subscription about nondeparturing. Chief of CDIA Kubanychbek Torobaev has explained, that it was made by Office of Public Prosecutor, and that he is confident, that now nobody will find Chynarbek Jumaliev.

In connection with above-stated, we ask you to give the answer to our questions:

- What change of a preventive punishment is relative to Chynarbek Jumaliev is caused?

- What refusal in change of a preventive punishment as the conclusion under guard of Dima Kapatsevich, the minor (14 year old), suffering chronic disease of the kidneys, not representing to a social danger is justified, the material damage on which act is compensated by parents?
