By the given letter Youth Human Rights Movement "Veritas" addresses to you to draw your attention to proceeding cases of rough infringement of the rights of the citizen of Chinese National Republic Tuhtaniez Muhammad, 1973 of a birth, Uigur by a nationality. We call you to interfere immediately with a situation and to promote T.Muhammad in restoration of the status of the refugee and clearing of the illegal conclusion.

At YHRM "Veritas" there is a trustworthy information directly from T.Muhammad which specifies that during last years his fundamental rights and freedom were roughly broken by law enforcement bodies of Chinese People's Republic, Republic Kazakhstan and already Republic Kyrgyzstan. In brief, offences in relation to T.Muhammad can be characterized in the following episodes.

> Since the middle of 90th authority of Chinese People's Republic began to pursue and put strong physical and psychological pressure upon T.Muhammad and members of his family, accusing them in kindling ideas of separatism in Xingang-Uigur autonomous region of the country. Then circumstances and illegal actions of the Chinese authorities have compelled T.Muhammad to leave the country and to arrive to Almaty, Republic Kazakhstan in 1996г. In Almaty T. Muhammad has addressed in representation of UNHCR and has received the status of the refugee.

Up to 2000г. T.Muhammad lived in Almaty and worked in sphere of trade. Since 2000г. law enforcement bodies of Chinese People's Republic began to demand from the Kazakh colleagues of detention and ex-tradition of T.Muhammad back to Chinese People's Republic. Law enforcement bodies of Republic Kazakhstan had no time to react to inquiry of the Chinese colleagues as T.Muhammad appeared in territory of the next Kyrgyzstan in investigatory isolator of Service of National Safety. As he has declared to representative of YHRM "Veritas", he has been stolen by employees of SNS of Republic Kyrgyzstan in territory of Kazakhstan. SNS of Kyrgyzstan has fabricated criminal case against T.Muhammad and began to accuse him in fulfilment of deliberate murder of the leader of Uigur diaspora in Kyrgyzstan N.Bajzakov and a member of official delegation of Chinese People's Republic in Kyrgyzstan Abdykadyr Gulam, and also in fulfilment of acts of terrorism. All accusation is constructed on T.Muhammad's grateful indications. During investigation he has been subjected to severe beating, him have forced to testify against himself and against others accused on the given criminal case. T.Muhammad by a verdict of Sverdlovsk regional court of Bishkek from December, 31 2001. has been recognized guilty in fulfilment of the above-named crimes and condemned for 17 years of imprisonment in a strengthened mode. It is necessary to note, that T.Muhammad has been condemned together with other persons whom he earlier never knew and did not see. Investigation and court represented them as accomplices and the organized criminal group. Thus neither the court, nor investigation did not considered and did not give a legal estimation concerning presence or absence of the status of the refugee at T.Muhammad and to the that fact how he appeared in territory of Kyrgyzstan. At judicial session T.Muhammad's fault was not proved.

Now T.Muhammad serves time in Colony-27 of Bishkek. From the moment of receipt in a colony of execution of punishment T.Muhammad several times in writing addressed in representation of UNHCR in Republic Kyrgyzstan. Till now he has not received the answer to the references. We have received the information that tomorrow, that is on October, 2, consideration of the application of T.Muhammad about his preschedule clearing or mitigations of punishment should take place. We know, that authorities of Chinese People's Republic also have addressed to law enforcement bodies of Kyrgyzstan with the request for T.Muhammad's ex-tradition. Probably that if T.Muhammad will be released ahead of schedule, law enforcement bodies of Kyrgyzstan can make an act of ex=tradition to back him to Chinese People's Republic, not looking on his status of the refugee. We also have an information that during such critical moments employees of SNS of Kyrgyzstan have strengthened psychological pressure upon prisoner T.Muhammad and demand from him a bribe for that they will not make an ex-tradition to Chinese People's Republic.

YHRM "Veritas" considers, that T.Muhammad's life is under danger and soon he is threatened with compulsory of ex-tradition back to Chinese People's Republic where concerning him the death sentence on political grounds can be born. We call representation of UNHCR in Kyrgyzstan to promote to T.Muhammad in restoration of his status of the refugee and to prevent his ex-tradition in Chinese People's Republic. The republic Kyrgyzstan is the participant of the International Convention on the status of refugees 1951г. and accordingly bears the obligation not to make the acts of ex-tradition of foreign citizens and persons without citizenship in such countries where is expected torture or severe, brutal and humiliating advantage with the person and punishment or the unfair adjudication. We also call the Supreme Court of Republic Kyrgyzstan to reconsider a verdict of guilty born in the relation of T.Muhammad and to justify him.
