Today, on October 16, 2006, at press conference in Bishkek the president of broadcasting company Adylbek Biynazarov has declared, that concerning Broadcasting Company " Pyramid " judicial instances of Kyrghyzstan make unprecedented decisions.

Him and the lawyer of mass-media Valery Ryabich so estimate the decision of the Bishkek interdistrict court on economic affairs from October 5 to which it refused in satisfaction of their claim about deducing from structure of founders of Broadcasting Company " Pyramid " Society with limited liability " Invest-media ". The last counts itself assignee SLL "Areopag", declares the rights to 50 % of a share of a broadcasting company and demands to deduce from management of its other co-owners. The owner of the biggest share - 35 % - is A.Biynazarov.

« The decision of court is born in our absence. We were not notified on process in due time. It is the roughest infringement of the law. Business should be considered in the Supreme court. We were refused to accept the statement of claim, and only four times after the Bishkek city court has recognized our documents corresponding to remedial norms, them have taken on consideration », - emphasizes V.Ryabich. As he said, the given decision will be protested in higher instances.

Such haste Adylbek Biynazarov explains desire of owners SLL "Invest-media" more likely to issue the company on itself. As he said, from here all attempts of force capture of a building of Broadcasting Company and deliberate damage of the equipment on September 28. The general damage from illegal actions of unknown people is estimated by "Pyramid's officials" in $200 thousand US dollars.

Institute of Media of the Representative: Concepts « extremist materials » will serve as a megaphone for influence on "objectionable" mass-media

BISHKEK (AEIpress) - Institute of Media of the Representative estimates amendments offered by the Ministry of Justice to some normal-legal acts, including in law of KR « About mass media » as « direct rough restriction of a freedom of speech in Kyrghyzstan ». About it, it is spoken in the statement of the Institute from October 16, 2006.

Let's remind, on November 16, 2006 in Jogorku Kenesh of KR was submitted by the initiators of the Government of KR «About entering additions into some acts of KR». The proposed law provides modification and additions in some normal-legal acts, including in law of KR « About mass media ». Namely, to add the third head of the law to clause 18-1 in the following contents: « distribution of the extremist materials through mass media and realization of extremist activity by them is inadmissible. It is forbidden to distribute extremist materials through mass media, and also to carry out the activity containing attributes of extremism ». For infringement of given article by journalists and mass-media it is offered to apply the maximal sanction as imprisonment from 5 till 10 years.

« The institute of Media of the Representative unequivocally estimates the mentioned above additions as direct rough restriction of a freedom of speech in KR, - is spoken in the statement. - Concepts « extremist materials », « extremist activity » in legislation of KR are determined as not specific and being estimated norms, will serve interested people as a real megaphone for influence on "objectionable" journalists and mass-media ».

« It finally will reduce practically to zero all achievements of democratic Kirghiz Republic during independence in the field of a freedom of speech and will form a basis for development of boundless censorship and self-censorship. Moreover, the specified additions roughly contradict of the point 2 of clause 19 of the International pact on the civil and political
rights which establishes, that a freedom of speech at all should be unfairly limited also to item point 8 of clause 65 of Constitution of KR forbidding acceptance of the laws limiting a freedom of speech and seales », - spoken in the letter of the organization.

In this connection the Public fund « Institute of Media of the Representative » calls deputies of the Jogorku Kenesh of KR to rise on protection of last democratic foundations in the Kirghiz Republic, on protection of a freedom of speech and not to approve the proposed law regarding entering additions into the law « About mass media ».

2.According to the decision of court half of  "Pyramid" will pass to «Invest Media»

According to the decision of court half of broadcasting company "Pyramid" will pass to possession of the company «Invest Media». Employees of"Pyramid" have addressed in court with the application for non-recognition as the unique owner the company «Invest Media ». The Bishkek interdistrict court having considered this business on October, 5 has not satisfied the given application. But about the decision of court claimants have learned only on October, 16. The decision this very day was made known to wide publicity by a management of "Pyramid", and was sharply criticized. The company «Invest Media » demands to recognize itself as the successor of company "Areopag " and to appropriate «Invest Media » 50 % of a broadcasting company "Pyramid" on the property right. And also to deprive some persons of supervising posts in "Pyramid". A management of "Pyramid" considering the given requirement illegal,  as 35 % of shares belong to Adylbek Bijnazarov, since December of this year, address in courts from regional up to Supreme:

- "Pyramid" and its members Bijnazarov, Vastik, Derbishev, Kaypov recognizing the decision on transfer of 50 % of "Pyramid" in hands of «Invest Media » illegal, have addressed in court. The application sent in accordence with the law was not accepted by court 4 times successively, - speaks lawyer Genady Rjabich. The reference of a management of "Pyramid" in interdistrict court is only continuation of these insinuations. But during consideration of the given application, the court has roughly broken the legislation as has considered it and has made a decision without participation of the applicant , speaks the lawyer:

- As in the Supreme court there was  a supervising complaint on consideration, the interdistrict court had no right to consider the given case. But despite of it, the decision for the benefit of « Invset Media » has been born. By this decision, they have opened road to capture of a telechannel "Pyramid". One of owners of "Pyramid" Adylbek Bijnazarov, has declared that, "Pyramid" will stand strong  on protection against illegal actions:

- They in fact attempt not only on "Pyramid". They play with fire, attempting on democracy, a freedom of speech, and people. We shall resist in every way. They will not take us.
Till now it is unknown who stands behind «Invest Media », that received decision of court to own advantage. "Pyramid" and its supporters assume that to take hold of influential mass-media, authority goes on such shifts: - They conduct "under carpet" intrigues. For example, those who has burnt the equipment were in masks. But law enforcement bodies perfectly know who they were, - speaks deputy of JK KR Kabai Karabekov . Chairman of the Commission of Human Rights at administration of President Tursunbek Akun speaks that for such accusations there are no bases:

- I cannot tell that in case of "Pyramid" is guilty present authority or supporters of "Pyramid".  there are no bases. But that, "Pyramids" has ceased to work, is very big loss for present authority. Even during time of rigidly criticized by us   mode of Akaev  "Pyramid"  was not closed. In December of the last year, the side considering itself as lawful owners has carried out attempt of capture of a building of "Pyramid" with the help of employees of law enforcement bodies. In this connection, were created the state and parliamentary commissions, during their work, it has been established that, scandal has arisen in connection with section of property. In September of this year unknown people burnt the technical equipment of a broadcasting company. On October, 12 public organizations, have lead picket at a building of the government, to protection of "Pyramid", with statements that, independent
mass-media are exposed to oppressions.

According to deputy Melis Eshimkanov participating in picket, behind « Invest Media » stands the son of president KR Maxim Bakiev.
