About inadmissibility of infringement of the law

By Office of Public Prosecutor of Lenin area, at check by way of supervision of execution of the legislation of the Kyrgyz Republic about mass media, it is established, that on November, 17, 2006 on page 8, $B-b(B75 newspapers "Agym " was published the material where the stenogram of ostensibly carried out by the President of the Kyrgyz Republic K.Bakiev with participation of Prime minister F.Kulov, State secretary A.Madumarov, head of Administration of President M.Abdyldaev and first vice-prime minister D.Usenov meeting was quoted.

Under the note of the edition, printed not at the end of the specified publication, but on page 14 of same number, the stenogram is a joke - parody. However, the foreword of edition to the publication creates false impression at the reader about reliability of data brought further. Moreover, in an epilogue to the publication the note on dimensions of a material and intention of edition to continue printing of the stenogram in following numbers is made.

All stated, and also the picked up collage of the extremely offensive character, discredit in opinion of the public the President of the country K.Bakiev and other supreme officials of the state.

Thus, you break requirements of article 23 of the Law of the Kyrgyz Republic "About mass media " according to which distribution in mass media of the materials breaking norms of civil and national ethics both encroaching on honour and advantage of the person, is inadmissible.

According to an article 49 of the Constitution of the country and an article 4 of the Law "About guarantees of activity of the President of the Kyrgyz Republic ", the President is under protection of the state, his honour and advantage are protected by the law. In case of distribution of the data discrediting honour and advantage of the President, the General public prosecutor is obliged, if other measures of public prosecutor's reaction have not brought necessary results, to address in court on behalf of the President.

On the basis of stated and being guided by articles 16 and 21 of the Law " About Office of Public Prosecutor of the Kyrgyz Republic " and an article 49 of the Constitution of republic. and the law " About guarantees of activity of the President of the Kyrgyz Republic ".
