Chronicle of persecution of KCHR The Government of Kyrgyz Republic doesn't interrupt the persecution of NGO - The Kyrgyz Committee for Human Rights and its collaborators. 1) In October 1995 in the eve of the presidential elections in Kyrgyz Republic the registration of NGO - The Kyrgyz Committee for Human Rights was repealed (at that time the Committee was called human rights defending movement). 2) On June 20, 1996 it was registered again with the present name. 3) In 1997 against the chairman of NGO - The Kyrgyz Committee for Human Rights was committed a try to call him to penal account on fabricated criminal case. Botaliev S., who was charged for theft, was discharged in exchange for giving information about Dyryldaev. This decision was taken as regards the fact that Dyryldaev defended the oppositional leader Turgunaliev T. and the judge Abdimomunov daily reported this to the Administration of the President. The director of the Administration of the President Dgumaliev K. gave an order to the Persecutor of Bishkek Kendgakunov to sue a criminal case against Dyryldaev, what confessed the Prosecutor Kendgakunov to Dyryldaev. The prosecutor removed the criminal case in course of the trial against Botaliev, what action he (Kendgakunov) was not in capacity to do. But in Kyrgyzstan everything is possible. 4) In 1998 the Ministry of Justice of Kyrgyz Republic deregistered NGO - The Kyrgyz Committee for Human Rights. 5) In September 1998 NGO - The Kyrgyz Committee for Human Rights collaborators Korgoldoev A., Batyraliev B. and Mamatislamov A. were arrested and charged on articles 163, part II, 199, 260 and 266 of Administrative Code for taking part in peaceful meeting. 6) In April 1999 instead of the present NGO - The Kyrgyz Committee for Human Rights a false NGO - The Kyrgyz Committee for Human Rights was registered, presiding by Botaliev S. 7) In August 1999 NGO - The Kyrgyz Committee for Human Rights was registered again under the pressure of the international community. 8) On 9 December 1998 the judge of Pervomay court in Bishkek N. Aseinova presented a decision to exact from NGO - The Kyrgyz Committee for Human Rights the amount of 33 721 soms (more than 1000 USD) on behalf of Eliseev A, a state duty in sum of 3 034 soms 90 tyiyn, 337 soms on behalf of the fund for development of the court and 800 soms on behalf of RNISE. Despite the illegal claim this sum was paid with the hope that it will put an end of the claims, but later according to the complaints of Eliseev the court passed more than 10 unlawful decisions. 9) On 23 December 1999 the Pervomay court in Bishkek passed a decision to exact from NGO - The Kyrgyz Committee for Human Rights on behalf on Eliseev 840 USD, 3 477 soms for the budget and 386 soms on behalf of the fund for development of courts. 10) On 24 May the judge Asanova of Pervomay regional court in Bishkek passed a decision of exacting from NGO - The Kyrgyz Committee for Human Rights on behalf of Eliseev A. 30 085 soms (more than 1000 USD), 2 707 soms for the budget, 300 soms 90 tyiyn on behalf of the fund for development of courts and 120 soms on behalf of RNISE. In the course of 1999-2001 years by the complaint of Eliseev A. to NGO - The Kyrgyz Committee for Human Rights more than 18 judicial decisions were passed concerning the same matter and every time the fine increased in arithmetic progression. In total NGO - The Kyrgyz Committee for Human Rights had to pay more than 5000 USD. Eliseev in all judicial institution had been appealing with the names of the president Akaev A. and the chairman of the Constitutional court Baekova Ch., declaring that he will take the whole property of NGO - The Kyrgyz Committee for Human Rights while the authorities are persecuting Dyryldaev. 11) On 3 June 1999 as revenge to Dyryldaev for his criticism towards the corruption of Baekova, the constitutional court of Kyrgyz Republic, presiding by Baekova passed an unlawful decision that between Eliseev and NGO - The Kyrgyz Committee for Human Rights has existed a work agreement. 12) On 26 June 2000 the judge of Pervomay regional court Maksimbekova passed an unlawful decision about the re-employing of Eliseev in NGO - The Kyrgyz Committee for Human Rights on elective post and applied a fine of 332 USD. 13) An appealing decision from 23 November 2000. The judicial board on civil cases, consisting of judges Alieva, Maliarova and Dospaeva passed a decision to fine NGO - The Kyrgyz Committee for Human Rights on behalf of Eliseev with 4000 soms “compensation for moral damage” and 161 soms on behalf of the state. 14) On April 7, 2000 against the chairman Dyryldaev Ramazan a fabricated criminal case was sued on article 338 of the Criminal Code of Kyrgyz Republic (non-execution of the decisions of the court). 15) On 7 April 2000 was sued a fabricated criminal case against the NGO - The Kyrgyz Committee for Human Rights collaborator Mambetaipov E. by article 335 of the Criminal Code of Kyrgyz Republic (waste of property) and in July 2000 he was sentenced to one-year prison. 16) July 20, 2000 more than 30 militia collaborators occupied the NGO - The Kyrgyz Committee for Human Rights office in Bishkek. The goal was to arrest the chairman of NGO - The Kyrgyz Committee for Human Rights. Instead of the chairman, his son Dyryldaev Almaz was arrested and beaten by the militiamen. Under the pressure of the international community the General Prosecutor of Kyrgyz Republic Ch. Abyshkaev announced the interruption of the criminal case against Dyryldaev R., thus trying to bring in delusion the international community but in fact the criminal case continued. As result to the threats on arrest Dyryldaev Ramazan and Almaz were forced to leave Kyrgyzstan and at the present they are working in exile in Vienna. 17) On 17 August 2000 the prosecutor of Bishkek Albanov passed a decree about ceasing the criminal case against the NGO - The Kyrgyz Committee for Human Rights chairman Dyryldaev R. It was made by formal motives in order to renew it at any time. 18) On 26 December 2000 the Supreme Court of Kyrgyz Republic repealed the decree of the Prosecutor in Bishkek from 17 August. Thus the court renews the suing. 19) On 5 February 2001 the judge of Pervomay regional court in Bishkek A. Sydykov passed a decision to oblige the prosecutor of Bishkek to eliminate the violation of Eliseev's rights that had been made, i.e. to renew a criminal case against Dyryldaev. Currently we are possessing punctual information that the administration of the president is demanding from the governmental structures by any fraudulent means to get Dyryldaev from Vienna back to Kyrgyzstan in order to put him in prison. 20) In November 2000 a criminal case was fabricated against the NGO - The Kyrgyz Committee for Human Rights collaborator Korgoldoev A. on article 234 of the Criminal Code (hooliganism). In February 2001 Korgoldoev was forced to leave Kyrgyzstan from beyond of continuing threats on arrest. In Austria he turned to authorities with ask for political asylum. 21) On 12 January 2001 the judicial board of Bishkek urban court passed a decision to exact from NGO - The Kyrgyz Committee for Human Rights for absenteeism the sum of 1440 USD, 7 056 soms as income of the state and on behalf of the fund of courts development 705 soms 60 tyiyn. 22) January 27 unknown committers attacked the collaborator of NGO - The Kyrgyz Committee for Human Rights Tynaliev B., put knife to his throat, took the documents of NGO - The Kyrgyz Committee for Human Rights and warned him that if he do not cease his work in NGO - The Kyrgyz Committee for Human Rights they will kill him, after that they beaten him and disappeared. 23) March 14 on grounds of judicial act the executor Umurkulov confiscated the property of NGO - The Kyrgyz Committee for Human Rights – computer, fax, telephones, scanner, ventilator and other technique. 24) May 1, 2001 in Jalal-Abad NGO - The Kyrgyz Committee for Human Rights collaborators Korgoldoev Eden, Sudakov A., Nujnov S., Kadyrbekov A. were arrested for participation in a peaceful meeting. Against them administrative cases were sued on articles 392 and 371 (“Violation of the established order of organizing and conducting of meetings, assemblies and street processions and demonstrations” and “Disobedience to the lawful order or demand of collaborator of Department of Interior Affairs or other persons in duty on protecting the public order”). The accused persons were fined with 20-50 USD. 25) May 23, 2001 the judicial board of the Bishkek urban court of Kyrgyz Republic presiding by Ibraeva Dgumagul Duishenovna justify without changes the decision of the Pervomay regional court from April 6, 2001, concerning the confiscation of the whole property of NGO - The Kyrgyz Committee for Human Rights - computers and other technique, including the regional offices, the furniture, which received by grant from the American Organization “Counterpart Consortium” in amount of 8 thousand USD, copy machine “XEROX” – 10 thousand USD, granted by Direction of the General Commissariat in Refugees Affairs of UN. 26) On 31 May Pervomay Court, presiding by judge Omorova passed the next unlawful decision concerning the fine, applied to NGO - The Kyrgyz Committee for Human Rights in amount of $ 1600 USD in favor of Eliseev. 27) On 29-30 May the judicial executor Umurkulov confiscated the whole property of NGO - The Kyrgyz Committee for Human Rights of its office in Bishkek by address: Ivanitsyna str. 123/87. 28) At the present in Pervomay court in Bishkek is beginning the consideration of the claim of Botaliev S. for admission of the registration of NGO - The Kyrgyz Committee for Human Rights from 20.06.1996 as invalid. If the court passes such a resolution in favor of Botaliev the present NGO - The Kyrgyz Committee for Human Rights will not exist for the Kyrgyz Government. Notice: Botaliev is in close collaboration with the special agencies and by his own words in order to use the NGO - The Kyrgyz Committee for Human Rights protection he has been often invited by the president Akaev. Botaliev himself is engaged in blackmailing but he has been always excused and all the complaints against him have been hidden by the special agencies. 29) On 12 June 2001 in Dgalal-Abad on Krasina str. While the NGO - The Kyrgyz Committee for Human Rights collaborator Kadyrbekov Abdymamat was waiting for a taxi militiamen came to him, detained him, put him compulsory in a car and drove him to the urban department of militia. During the route the militiamen had beaten him. After that the militiamen prepared a false report that Kadyrbekov has been resisting. Against him investigator Dg. Subankulov sued a criminal case by article 341 of the criminal Case of Kyrgyz Republic (applying violence in relation to representative of authority). The Militia collaborator that had detained Kadyrbekov, prepared a false medical certificate for himself that he has cranium-brain trauma and brain concussion and he is currently in a hospital. In reality the militiaman is free. 30) On 27 June 2001 the NGO - The Kyrgyz Committee for Human Rights collaborator of Osh region Arkabaev was arrested on fabricate criminal case by the collaborators of National Security Services of Kyrgyz Republic for Osh region. On 27 June in the NGO - The Kyrgyz Committee for Human Rights office in Osh was conducted a search and the National Security Services sealed up the office. During all these years the Kyrgyz authorities have shadowed the NGO - The Kyrgyz Committee for Human Rights collaborators and their relatives, their telephones have been eavesdropped, a pressure was applied, the collaborators have been imprisoned, the NGO - The Kyrgyz Committee for Human Rights offices were permanently visited by judicial executors, militiamen, officials from special services and others. In spite of these conditions NGO - The Kyrgyz Committee for Human Rights strengthen its activities. 31) On June 27, 2001 the NGO - The Kyrgyz Committee for Human Rights collaborator of Osh region Arkabaev was arrested on fabricate criminal case by the collaborators of National Security Services of Kyrgyz Republic for Osh region. On 27 June in the NGO - The Kyrgyz Committee for Human Rights office in Osh was conducted a search and the National Security Services sealed up the office. A criminal charge was fabricated against him on the reason that Arkabaev tried to publish material about corruption among the state officials; the material reveals that many heads of districts were involved in corruption, including directors of Ministry of National security of Kyrgyz Republic. After the interference of international organizations and the Special Reporter of UN Secretary General on Human Rights Defenders Mrs. Hina Jilany the criminal proceedings against Arkabaev N. was dropped from beyond the lack of proofs. 32) On September 19, 2001 during the visit of President Akaev at the OSCE Permanent Council, the NGO - The Kyrgyz Committee for Human Rights activists in exile Dyryldaev Almaz and Korgoldoev A. together with the refugees of "Ar-Namys" party conducted a demonstration; some men from the guard of President approached the activists and were threatening to kill them if they turn back to Kyrgyzstan. 33) On October 17, 2001 judge Maksimbekova of Pervomay Court delivered a judgment to fine the "Resoublica" independent newspaper in amount of 300,000 soms (6,300 USD) as well as 8 members of the governing body of NGO - The Kyrgyz Committee for Human Rights and the chairman of NGO - The Kyrgyz Committee for Human Rights, Dyryldaev Ramazan, who were fined in total amount of more than 300 USD. During all these years the Kyrgyz authorities have been persecuting the NGO - The Kyrgyz Committee for Human Rights collaborators and their relatives, their telephones have been eavesdropped, a pressure has been applied, the collaborators have been imprisoned, the NGO - The Kyrgyz Committee for Human Rights offices have been permanently visited by judicial executors, militiamen, officers of special services and others.
