Report of the Kyrgyz Committee for Human Rights on torture in Kyrgyz Republic Kyrgyzstan ratified Convention against Torture in July 1996. However, Kyrgyz government ignored recommendations of the Committee against torture from 1999 and recommendation of the Committee on Human Rights of UN from 2000 in order to stop torture. After publication of reports on torture in November 1999, Committee of UN made recommendation to the government of Kyrgyzstan to prevent torture. Unfortunately, nothing was done and government did not take any actions. Roistering of law enforcement agencies are continuing by taking to police department innocent people and beating them in order to get money or to take responsibility for crimes that they did not commit. There are very few cases when staff members of law enforcement agencies were charged for using torture against people. Kyrgyz law, particularly Criminal Code of KR, does not cover “torture” and there is no punishment for using torture yet. In 2002 Kyrgyz Committee for Human Rights sent project for consideration to the Committee on judicial issues of the Kyrgyz Parliament, which suggested changing some articles of the Criminal Code by eliminating death penalty and application of punishment for officials using torture. Today Committee for Human Rights on judicial issues of the Kyrgyz Parliament is considering these changes and it has to come up with final document on the Legislative Assembly of Parliament. It is not a secret that during preliminary investigations the law enforcement agencies torture suspects and remands. The government of Kyrgyzstan should urgently hold reforms in law enforcement system, which works only for governing regime but not for people. Moreover, police officers can beat even Parliamentarians at the trial center. What can we say about common citizens when ex Vice President of Kyrgyzstan Felix Kulov was beaten at the court hall in front of many people by police? Below we listed only some facts of what happening inside police and this is an only little part of reality. On February 2002 in jail at Jalal-Abad trial center Parliamentarian A. Beknazarov was beaten by unknown people with masks. Afterwards, he hardly walked. In April 2002 at the Department of Internal Affairs of Aravan district in Osh oblast citizen of Uzbekistan Burikulov was killed. For the last five months responsible people on his death are not found and not punished. According to the conclusion of medical assessor, Burikulov died as a result of asphyxia. In other words, as police says, he hanged himself at police department of Aravan district in Kyrgyzstan. However relatives of Byrikulov say that he was killed at the police, where he was tortured during three days after his arrest. According to his relatives, his body was brought from Kyrgyzstan with apparent injuries of torture. There were serious injuries of head, back, chest and legs. On suspicion of rubbery of the cattle was arrested E. Kadyrov, a resident of Bishkek, by officers of Chui District Department of Internal Affairs (DDIA): major of police Bakyt Ryskulov, sergeant major of police Tilek Osmonov, first lieutenant of police Kuvan Tabaldiev and lieutenant of police Duishen Ibraev. He was kept at the City Department of Police for about 24 hours, where at the beginning he was beaten by plastic truncheon on his head, and then he got beaten and kicked. Kadyrov was made to take responsibility for crime that he did not commit. Conclusion of medical expertise showed that Kadyrov’s injuries are results of beat with truncheon. On suspicion of rubbery of the cows was arrested in April 2002 Turar Musaev, a resident of Ak-Olon village in Issyk-Kul oblast. First lieutenant of police R. Ashirbaev beat Musaev on his head with stone and plastic truncheon. Afterwards, Ashirbaev brought pliers and clutched Musaev’s tongue and made him admit guilt on crime that he didn’t commit. Also Ashirbaev pinched his skin on his back, under collarbone, on his face and pulled his nails. Staff lieutenant Ashirbaev kept Turar in the village police department till morning, and then drove him 90 kilometers away from his home village-to Bokonbaevo village. There he kept him in small decrepit house for one week, so his injures from tortures would heal. The house was rented by two young men, who were friends of policeman. They were working the whole day and policeman stayed with Turar 24 hours, even convoyed him to the restroom. After one week Ashirbaev let Musaev go home and gave him 30 soms for transportation. Musaev had to go to a hospital. Medical assessor took pictures and noted the injuries from tortures. On April 14th 2002 29-year old Sadygaliev N. was arrested on suspicion in stealing cattles. Sadygaliev couldn’t outstay tortures or maybe policemen “helped” him, and committed suicide in Moscovskiy ROVD, Chui oblast. Delinquents in his death were not punished i.e. regional prosecutor refused to commence case due to the absence of corpus delicti. “Better bandits, than people in the uniform”- this is the opinion of two collegues-Talant Djaanbekov and Kurmanbek Bataliev. And it is really hard to talk them round. Talant and Kurmanbek still feel consternation when they remember that night, when they had to experience what it like to communicate with people who proudly call themselves policemen. Three unknown persons stopped Talant Djaanbekov and Kurmanbek Bataliev at the entrance to city police department #15 on Ahunbaeva street. -We are from police, follow us,- they heard and of course listened to the strict voice: never argue with policemen. But in the building young men were beaten by them. There was only one questiong whether they had money or not. Builders had about 950 soms( 20$), but they didn’t want to give them away. And Talant with Kurmanbek offered resistance. Another man joined three policemen. Young men were twisted and taken outside. There they sat in the car and policemen drove them to deserted constructions near Kyrgyz Technical University. They kept beating them there. At some moment Talant ran away to the dark, when he came back Kurmanbek was laying on the ground, passed out. And without money. Victims couldn’t leave it like that, they were beaten they had injuries; one of them had broken ribs, another-broken nose. Conditions under which suspects and prisoners are kept Prisoners don’t go through medical examination when they come to the jail, even though it is very important, i.e. some prisoners or suspect have infections (tuberculosis, AIDs). Nobody takes care of following diseases. Those who have tuberculosis or AIDs are kept in one ward with healthy ones, infecting them. Every year the percentage of tuberculosis patients increase. More over, there are lethal cases, but administration keeps silent about that. Prisoners don’t have an access to psychologists. Prisoners don’t receive enough food, and the one that they get hardly can be called food. Relatives of prisoners bring necessary foodstuffs (potatoes, axunge). There are not special diets for those who have different types of infections. Anti-sanitary situation, no showers, maybe paid ones 50-100 soms (1-2 USD).More over they don’t have a permission to have conditions for personal hygiene, no toothpaste, no toothbrush, soap and shaving stuff. For example, in Djalal Abad jail, they don’t even have restroom; instead there is a bucket in the center of the ward, and 12 people. Prisoners try no to eat and drink in the evenings, so they won’t fill that bucket. There are 12 people in one ward instead of 8. Administration of jails very often use tortures toward their prisoners.. It is wide known that the conditions in the jails of Kyrgyzstan are terrible. As the result of terrible conditions every year hundreds of people die of tuberculosis and other diseases. The main reasons are hunger, congestion, the absence of simple conditions of minimal standards; low temperature in winter, hot in summer in cameras. As the result a lot of deaths, but government officials never tell what they do with dead and never tell the relatives of the dead. By hiding the death of the person, government officials do business on this, i.e. corruption on low conditions in jails, is a way of torture. First of all only a half of corpses were subject to medico legal expertise. The rest of the corpses were sent to the cellars of Medical Academy of Kyrgyz Republic. As the result of expertise of corpses from the cellars, it was proved that in 4 cases there were indications of deaths of torture (assassination). This allows us to talk about the concealment of assassination. From the hospitals the corpses are sent to expertise without photos, thus the expertise people cannot compare. Thus there is a possibility of stand-in. Meaning that instead of the convict who was in jailed for a long period of time, it is possible to register someone else’s body, but the killer or torturer at this moment with no problems is free. Administration of the jail must inform the relatives of died convicts. We have checked several addresses, by the end of September we will finish this job. A sister of one convict thought that her brother went under amnesty and he will be freed in half a year. But he died in jail 6 month before, but no one informed his sister. In other case, the information went to convict’s 90 year old grandmother, but his father, wife and children didn’t know anything. Sometimes the information about convict’s death goes to his/her old address, where no one no longer knows anything about him/her. In Osh oblast, we got the reference that Imarek, who died long time ago, still alive and lives there. This means that government bodies are also not informed, and in address bureaus, dead people are thought to be alive. Maybe at this point they were already turned into medications. Republic medico legal expertise in the Institute of morphology and polymeric goods found only 100 corpses. There is information that they were buried for city expenses. A half of them didn’t even have name tags. The rest of corpses were gone in unknown direction… On October 24, 2003 deputy directory of National Security Services (KGB) Poluektov informed the Parliament that every month 7-10 prisoners die in prisons of our republic because of lack of minimum standards of imprisonment. Usually 40 years old men die since men that are condemned to death penalty are kept in horrible conditions and they ask the President to cancel the moratorium to death penalty because they prefer to die rather than suffering in those conditions. Besides bad conditions of prisons, prisoners suffer in hunger because of the lack of food for prisoners. Also at the same day Parliament learned that the law enforcement agencies did not investigate ten cases of deaths of prisoners and Parliamentarians think that some of them were killed in torture. All these facts were hidden from official report as murders. Victims of Aksy tragedy Report on results of investigations in the villages of Kerben and Bospiek from January 5 to April 16 2002. People held demonstrations every day in Bishkek and Aksy region in order to protest against the arrest of MP A. Beknazarov. Around 700 people went on hunger strike. The representatives of the security forces dispersed protestors. Some of the protestors were arrested, including women and children, and brought to the Regional Department of Interior (ROVD), where physical force was used against them. This happened twice in Bishkek, twice in the Toktogul region and many times in the Aksy region. On March 17, people were shot on the road from Kara-Suu to Kerben, on their way to the regional center in Kerben. Overall, around 200 people received various physical injuries. Several people were arrested and were held responsible for organizing the upheaval. Many of these people were brought to Police Departments, where they were tortured. Many of them were severely beaten and then were forced to admit actions they had not committed and to sign papers, the content of which they did not even know. The following evidence supports the statements above: Ulanbek Israilov was arrested on March 18, 2002 and brought to Aksy ROVD. He was severely beaten by policemen with a bludgeon. After that Mr. Israilov was forced to put his hands on the concrete floor and one of the policemen put a chair on his arms and stood on the chair, meanwhile he was also beating his legs with a bludgeon. A sum of 150 soms and a golden ring were taken from Mr. Israilov’s pocket which he never got back even after the investigation. Mr. Israilov was also forced to sign several documents that were prepared by the police. Ulanbek Israilov was released on March 19, when Beknazarov came to the region. Kuttubek Duishobaev was arrested on March 19, 2002 and was severely beaten with a bludgeon and other objects. Mr. Duishobaev was interrogated with a gun pointed at his head. Under such conditions the policemen demanded he name the organizers and leaders of the demonstrations. Duishobaev was also forced to sign several documents without knowing the content, which had been prepared by the policemen. The policemen took a quittance of not leaving the region before releasing him. On March 22, 2002 Mr. Duishobaev fell ill and went to the local hospital. Policemen met him on the way to hospital and brought him back to the their office, where he was beaten once more. Upon release he was notified that without police permission he was not allowed to go anywhere. Niyazbekov S. was arrested on March 19, 2002 and brought to ROVD where he was beaten and as a result taken to hospital. While Niyazbekov was at the hospital the local inspector came to visit him. He made him write a note stating that he had fallen from a tree and therefore had gotten injured. Batyrbek Nishanov was arrested on March 19, 2002 and brought to ROVD where he was beaten with a bludgeon. He was forced to admit that he was carrying a bottle of gasoline and that later he had set fire to the building of the children inspection (IDN). Habibula Japarov was arrested at 8:30 p.m. on March 18, 2002, when going home. Later the policemen beat him up. Other people and he were stripped of their clothes and beaten with a bludgeon after which they poured cold water on them. They were forced to lie on the concrete floor covered with water for two-three hours. All of them were forced to sign several papers without being allowed to see the content of the papers. Temirkulov Alymkul was arrested on March 19, 2001, on the street and was taken to ROVD, where he was beaten. He was stripped of his clothes and beaten on the heels. Temirkulov was forced to admit doing things that he had not done and threatened with a syringe. He was forced to sign the interrogation protocol saying that he had a bottle of gasoline. The policemen took a picture of him holding a bottle. Also, he was forced to say that he was drunk and was throwing stones at policemen. The policemen hit Temurkulov in the head with a metallic object. As a result of injuries he still has headaches and pains. Myrzabekov Samagan was arrested on March 19, 2002. He was beaten and forced to admit that he was drunk and throwing stones at policemen. Also, he was forced to sign several documents and the interrogation protocol. Sheraliev Altymysh was arrested on the street on March 19, 2002, and beaten. Policemen took his backpack and filled it with stones. He was forced to sign several papers. Alybaev Kulmyrza was arrested on March19, 2002. He was beaten up and interrogated about the videotape to locate its whereabouts. Jumashaliev Nurmamat was arrested on March19, 2002 and taken to ROVD despite the fact that he was ill. Jumashaliev was going to the hospital but he was arrested, taken to ROVD, and beaten up. As a result of battery he lost consciousness. Only after this was he taken to hospital. Ziyatdinov Fatih (born in 1985) was arrested on March18, 2002 and taken to ROVD where he was beaten up, prodded with a needle and forced to admit that he had set fire to the Children’s Inspection of Police (IDN). He was brought to ROVD on March22, 2002 and taken to IDN where the police played back the incident. Chomoev Tariel was arrested on March18, 2002 and taken to ROVD, where he was beaten, resulting in a broken arm and concussion as a result of being beaten in the head with a bludgeon. Then his hands were tied and policemen continued to beat his arms. He was forced to sign a protocol which he was not allowed to read. Smanbaev Abdrasul was arrested on March19, 2002 and taken to ROVD where he was beaten and interrogated about the videotape. Policemen took pictures of him and forced him to sign the interrogation protocol before letting him go. He was forced to sign papers saying that he would not go anywhere without police permission. Usupbaev Temir was arrested on March18, 2002 when he was returning home in the evening. He was brought to the police department and beaten up. Policemen kicked him in the mouth and as a result his upper lip started to bleed. Besides, a policeman from Ala-Buka ROVD beat him up. Aitiev Janybek was arrested on March19, 2002 and taken to ROVD where he was beaten with a bludgeon. He was taken to a cell (IVS) and forced to stand facing the wall and lift his head while policemen hit his legs and kidneys. The police forced him to sign several papers without letting him read the content. The policemen put stones in his bag and took a picture of him holding the bag. Baidolatov Aykul was arrested on March19, 2002 and taken to the police department. He was forced to stand facing the wall and to lift his hand while the policemen beat him with a bludgeon. His bag was also filled with stones. The police forced Baidolatov to sign several papers without letting him read the content. Byljyev Bolotbek was arrested on March 19, 2002, and brought to the Regional Department of Interior (ROVD), where he was beaten while standing facing the wall. He was beaten all over his body. The police put stones into his backpack and took a photo of him. He was also forced to sign the interrogation protocol. Anashev Ahyr was arrested on March 19, 2002, and brought to ROVD, where he was beaten while standing and facing the wall. The police put stones into his backpack and took a photo of him. He was also forced to sign the interrogation protocol. Anashev Ashyr came to the meeting walking with a limp and using a stick, since his foot was aching, but he did not go to hospital out of fear. Anashev also did not write a report out of fear so his wife wrote it for him. Atabaev Rysaldy was arrested on March 19, 2002, on the way to hospital with his family to show his son to the doctor. On his arrival to Kerben, Atabaev left his wife and son in the hospital and went to a store. On the way to the store he was arrested and brought to ROVD, where he was beaten with a bludgeon. He was also forced to sign several papers. Myrzakmatov Sagynbay was arrested on March 19, 2002, and brought to ROVD. There he was beaten, kicked, his hands were twisted, etc. He was forced to sign a paper saying that he was drunk and participating in the picket. In fact he was sober and was returning from work. Policemen arrested Shobdanov Mirlan at 20.00 near the gastronome on March 19, 2002, where he was with his friend Myrzakmatov. Shobdanov and Myrzakmatov were taken to ROVD and on the way there were beaten with a stick and their hands were twisted. Thus, they were forced to tell that they were drunk and had taken part in the picket. Esenova Bubuhajan was arrested on March 19, 2002, was beaten with a bludgeon in the head in the village of Bospiek. As a result of injuries, she went to the hospital were she stayed for several days. After she was discharged, the headaches did not stop and she went to hospital again. Bazarbaev Begaly was arrested on March 19, 2002, brought to ROVD, put into a cell and beaten with a bludgeon and kicked. According to him there were 37 people with him. He saw how other people were stripped of their clothes, beaten up, and had cold water poured on them, after which they were forced to stand on a cold concrete floor. Kudaiberdiev Taalaybek (born in 1979) was arrested by policemen when walking home with his 3-year-old son on March 18, 2002. He was taken to ROVD and his son was left in the street without supervision. Kudaiberdiev Taalaybek was severely beaten up, stripped of his clothes, and forced to lie on a cold concrete floor while cold water was poured on him. Kudaiberdiev Taalaybek fell on the floor when a policemen hit him in the head with a bludgeon and pressed his head to the floor with his foot. After all of this Kudaiberdiev Taalaybek and other arrested people were forced to apologize to the policemen for torturing them. Turgunaliev Asylbek (born in 1983) was severely beaten up by policemen in the village of Bospiek on March 18, 2002. As a result of injuries he went to a hospital where he stayed and was discharged after several days. However, because of the pain he went to the hospital again. He has injuries in the head, and as a result has been having constant headaches. Ozokeev Kutman was arrested on March18, 2002, and taken to ROVD, where he was beaten up with a bludgeon. In addition, he was forced to sign several documents, which he was not allowed to read. Ashirova Gulbara (born in 1971) was arrested on March18, 2002, by the policemen of the security forces in the village of Bospiek, and taken to ROVD, where she was held for several hours. Tanabaev Duyshobay (born in 1973) was arrested on March18, 2002, by police and taken to ROVD, where he was beaten up with a bludgeon. The police forced him to sign several papers, without letting him read their content. Ismanbaev Abdinazar was arrested on March19, 2002, and taken to ROVD, where he was hit several times in the head with a bludgeon. Then the police forced him to sign several papers, without letting him verify the content. Jolchuev Kasymaly (born in 1962) was arrested on March18, 2002, and beaten with a bludgeon. He was forced to stand facing the wall, lift his hands, and the policemen hit him in the kidneys. His bag was filled with stones, and policemen took a picture of him holding the bag. After, he was forced to sign several papers, the content of which he did not know. Sydykov Kadyrbek (born in 1965) was arrested on March19, 2002, and taken to ROVD, where he was beaten with a bludgeon. He was forced to stand facing the wall with his hands on his head while the police beat him with a bludgeon. He was forced to sign several papers and signed a declaration stating he would not go anywhere without police permission. Anarkulov Asan (born in 1979) was arrested on March19, 2002, and taken to ROVD, where he was beaten in the head and legs. As a result of injuries caused by the police, he went to hospital and had to go through treatment. Shaydildaev Satimbay (born in 1954) was arrested on March19, 2002, taken to ROVD, and beaten up. He was forced to admit doing things he had not done. Narbaev Baktybek was arrested on March19, 2002, and taken to ROVD, where he was beaten for 15-20 minutes. The police then forced him to sign several papers, without letting him read their content. Ajikulov Sumsarbek was arrested on March19, 2002, and beaten on the way to ROVD. In the ROVD he was forced to stand facing the wall while the police continued to beat him. Mominov Abdygapar (resident of Namangan oblast, Uzbekistan) was arrested on March19, 2002, taken to ROVD, where he was beaten in the head and kidneys. After he was freed he went home and did not appeal to anyone. Abdrahmanova Nurjan was arrested on March18, 2002, when she was returning home. She was taken to ROVD and held for 24 hours without a reason. In ROVD she saw how policemen beat other people. Akbalaeva Jypar was arrested on March17, 2002, and beaten with a bludgeon in the village of Bospiek, after which she was forced into a car and taken to ROVD, where she was held for several hours. Omurbekova T. was arrested on March17, 2002, and severely beaten by the police in the village of Bospeik. She barely managed to run away. Policemen arrested Imanova B. (born in 1964) on March 17, 2002, in the village of Bospiek. She was taken to ROVD by force, where she was held for several hours. Tagaeva Saadakan was severely beaten with a bludgeon in Bospiek, then she was arrested and taken to ROVD by force, where she was held for several hours. Orozbaev Anarbek was going to the village of Kerben with his 12-year-old son Orozbev Temirbek to call on his other son, who studies in Bishek. On the way there policemen stopped the bus and arrested him and his son and took them to ROVD, where they were held for 6 hours. Orozbaev Temirbek (born in 1990) was going to Kerben with his father Orozbaev Anarbek to call on his brother in Bishkek. On the way the policemen stopped the bus and arrested both of them, took them to ROVD, and held them for 6 hours. Myrzagulova Kuluchay, a mother of 5 children, was in her third month of pregnancy. Policemen in Bospiek beat her up on March 17, 2002. Several times she was hit in the head and other places with a bludgeon. As a result of injuries there was a threat of miscarriage. Togaeva Jypar was beaten with a bludgeon by policemen in Bospiek and taken to ROVD, where she was held for several hours. There were other 5 women in custody with her. Niyazova Rysbu (born in 1965) was beaten with a bludgeon by policemen in Bospiek on March 17, 2002. She was taken to ROVD by force and held for several hours. After which she felt ill and went to the doctor. Imanalieva Batma was beaten up by policemen on March17, 2002 in Bospiek, and was taken to ROVD, where she was held for several hours. Policemen on March17 beat Kongatieva Aiym with a bludgeon. She was beaten all over her body. As a result of this she had to be hospitalized. Also, she was a witness of the clash between police and demonstrators. One of the wounded told her that a policemen named Baymurat had shot at him. Imankulova Meilikan (born in 1952) was beaten with a bludgeon by policemen in Bospiek. Bostanalieva Nurjamal was beaten with a bludgeon by policemen in Bospiek Jumanaliev Bektemir was arrested by a colonel near the hospital in Kerben on March19, 2002. He was beaten to the point that he lost consciousness. He was taken to hospital by other people (non-police). Myrzabekov S. was arrested in Kerben on March19, 2002 and was taken to ROVD, where he was forced to stand facing the wall. Meanwhile policemen beat him. Atokanova Suyuna was arrested forcefully when she was taking part in the demonstration in protest of Beknazarov’s arrest in Toktogul. Policemen twisted her hands, pushed her into a car, and took her to ROVD. As a result of such treatment her arm was broken. Policemen in Bospiek on March17 beat Kobogonova Baiatygul with a bludgeon. Bostonalieva Nurjamal was beaten with a bludgeon by policemen in Bospiek on March17. Ysmanbaev Abdynazar was arrested and taken to ROVD on March19, 2002. In ROVD he was beaten in the head with a bludgeon. Mergenbaev Abdynazar was arrested and taken to ROVD, where he was beaten in the head with a bludgeon on March19, 2002. Aitmatov M was arrested and taken to ROVD, where he was beaten in the head with a bludgeon on March19, 2002. Jumanov U. was arrested and taken to ROVD, where he was beaten in the head with a bludgeon on March19, 2002. Kaikiev B was arrested and taken to ROVD, where he was beaten with a bludgeon on March19, 2002. He was forced to admit doing things he had not done. Abdrahmanov A. was arrested and taken to ROVD, where he was beaten with a bludgeon on March19, 2002. He was forced to admit doing things that he had not done. Sultanov J. was arrested and taken to ROVD, where he was beaten with a bludgeon on March19, 2002. He was forced to sign several papers. Shabdanov Maksat was arrested, taken to ROVD, and beaten up. Alimbekov M. was arrested, taken to ROVD, and beaten up. Abdiev Nurlan was arrested, taken to ROVD, and beaten up on March18, 2002. He was forced to admit doing things that he had not done. Narbaev Baktybek was arrested on March 18, 2002, and beaten up in ROVD. He was forced to sign several papers. Policemen beat Adylbekov Iktiyar with a bludgeon on March 17, 2002. Absamatov Sanjarbek was beaten up by policemen on May 18, 2002. Policemen beat Jumanaliev Bektemir with a bludgeon and other objects on March 19, 2002. Policemen near Bospiek beat Yzabekova Kaira with a bludgeon. Policemen near Bospiek beat Ryskulova Burulkan with a bludgeon. Omurbekova T. was beaten with a bludgeon near Bospiek. Baltabaev Orozbek was beaten near Bospiek. Akbalaeva Jypar was beaten up near Bospiek, after which she was taken to ROVD. Chikirova Aichurok (born in 1962) was beaten up near Bospiek. Then she was taken to ROVD, where she was beaten again. Ismanbaev Abdinazar was beaten up in ROVD on March 19, 2002. Byluev Bolotbek was arrested on March 19, 2002, and taken to ROVD, where he was beaten up. As a result of this he became deaf. Among the beaten there were 25 women and 4 children under the age of 18. The policemen shot him on May 18, 2002, in the village of Kerben. The policemen in the car (UAZ) chased him and shot him. The situation in the Aksy District is getting worse today and if the government does not fulfill the people’s requirements, the population will start protesting again. |
