Press-release Additional meeting of OSCE on human rights issues in “Preventing tortures” took place in Vienna, Austria on November 6-7, 2003. Many speakers and participants pointed out the existence of tortures in OSCE region. All participants accused the continuing tortures in OSCE region, especially; countries such as Turkmenistan, Azerbaijan, Georgia, Uzbekistan, Russian Federation and Kyrgyzstan were harshly criticized. Kyrgyz Committee for Human Rights – chairman Ramazan Dyryldaev, member of administration of KCHR Albert Korgoldoev, leader of “Civil Society Against Corruption” Tolekan Ismailova, leader of “Kylym Shamy” NGO Aziza Abdrasulova, Valentina Gritsenko, human rights NGO “Justice” and three other representatives of pro-government Associations of NGOs presented Kyrgyz independent NGOs. International Helsinki Federation for Human Rights (Vienna) and Kyrgyz Committee for Human Rights (Dyrydlaev R.) distributed special report on systematic tortures in Kyrgyzstan. In report KCHR gives large number of torture facts, including victims of Aksy tragedy. Leaders of Kyrgyz NGOs and Ramazan Dyryldaev mentioned that Kyrgyz Republic had ratified Conventions against tortures (in 1996). In 1999 Kyrgyz government made a report to Committee against tortures in UN; however, it didn’t implement its duties and ignores them to nowadays. Tortures are not investigated, and even if they are investigated they don’t reach a court. Prosecution often doesn’t answer straight and saying that facts are not proven. Ramazan Dyryldaev said that Kyrgyz government refused to investigate Aksy tragedy, and people directly guilty in Aksy events still have higher governmental positions. This way President Akaev shows that he himself was interested in fusillade of peaceful citizens, while he was saying to his own people and international society that those guilty in tragedy have to be punished. Republican prosecution found equitable actions of police and OMON, who used weapons against civilians. Dyryldaev R, also informed that he with his colleagues prepared draft bill, which considers special article for tortures in law book of Kyrgyz Republic; they discussed it on the round table and after that bill was directed to parliament. Kyrgyz parliament approved the bill and sent it to the President for his signature; however President didn’t sign it and put veto on it. Parliament descried it again and sent it back to the President; however the bill is still not signed. Tolekan Ismailova in her speech gave many facts on tortures of peaceful demonstrators in Bishkek and Barskoon and other regions of the country. She talked about absolute absence of supremacy of law in Kyrgyzstan. The main reason for that is corruption, especially family-clan politics. She also mentioned that human rights defenders and civil activists become victims of family-clan regime and representatives of 80 nationalities don’t have an access to participation in politics and don’t have an access to resources. In conclusion she stated that Kyrgyzstan today has a police regime, which oppresses civil initiatives. Aziza Abdrasulova told about rejection of visa to Dilbar Momkulova-leader of “Mothers of Aksy tragedy’s victims”, by NSS of KR and she also described the fusillade in Aksy region on March 17,18,19, 2002. As a member of public committee Aziza researched, was a witness, and also people told many facts on tortures of Aksy people. More than 90 people were tortured in Aksy and other ROVDs, they were beaten, then put on the cement floor and swilled by cold water, and put stones in the hands of those who were shoot, so later they could accuse them. She also had a tape, which was recorded by NSS, where the fusillade of peaceful civilians is clearly shown. This tape accidentally ended up in the hands of demonstrators. In special room the tape was watched and participants admitted that these certifications were horrible and anti-human. Valentina Gritsenko in her speech said that her NGO hold seminars with police, where it was said that in Kyrgyzstan it is impossible to conduct investigation without use of tortures. Valentina showed an example, where one prisoner accused for robbery of an engine, after the implementation of tortures admitted another 37 robberies. This way Ministry of Internal Affairs increases the percentage of opened crimes. Tolekan Ismailova and Valentina Gritsenko criticized the OSCE project on reforms in law enforcement bodes and asked to reconsider the component of providing police with less lethal gas, handcuffs and armored tanks, these arms will be used against activists and human rights defenders in the pre-election period in 2005. On the third meeting of OSCE, Ramazan Dyryldaev suggested that OSCE has to keep statistics of tortures and conduct investigation on each of them. Ramazan Dyryldaev also called participants to establish new committee in OSCE, which will investigate facts on tortures, when state doesn’t react and hides the facts. Ramazan Dyryldaev also said that OSCE shouldn’t keep silence about Aksy tragedy and reminded about appeal of victims of Aksy tragedy to executive chairman of OSCE and OSCE delegations on investigation of facts of tortures, used by Kyrgyz authorities with Askar Akaev at the head. He also called participants to work together to clear the skirts of Kyrgyz nation, i.e. Aksy tragedy is equal to the crime against humanity, and those who are guilty have to be punished in accordance to international responsibilities. Tortures were harshly criticized by state delegations of USA, Armenia, Ukraine, Uzbekistan, Italy on behalf of European Union. Ismailova T., Abdrasulova A., Korgoldoev A., Dyryldaev R. took part in the special briefing, which was held by International Helsinki Federation for Human Rights with Human Rights Watch(Rachel Denver), and International League for Human Rights (Peter Zalmaev).
