Press-Release:

KCHR have informed several times, have criticized President Askar Akaev for not signing the Law, which was adopted by the Parliament, the law “on making amendments “tortures” into the Criminal Code of Kyrgyz Republic”.  This law bill was prepared in accordance to recommendations of UN Committee on Tortures, which were adopted in 1999 during report of Kyrgyz Republic.  (The government was represented by General Prosecutor of KR A. Sharshenaliev, Minister of Internal Affairs Kutuev and Chairman of National Commission on Human Rights under the President Tursunbai Bakir uulu, who is now Ombudsman of KR.  All of them promised to write a law on tortures.)  But the government didn’t introduce the law, by this violating recommendations of UN Committee on Human Rights.

In fall of 2002 the law bill was introduced by the Chairman of Kyrgyz Committee for Human Rights Dyryldaev R., and by the member of the Board of KCHR M. Osmonaliev, the law bill was prepared and introduced to the Parliament (the legislative branch Jogorku Kenesh) through the deputy of the Parliament Beknazarov A., who have supported and have introduced to the committee’s consideration, and then to the consideration of Parliament.  The law bill was adopted in spring of this year and was send to the President.  But President has vetoed it.

In fall of this year the Parliament of Kyrgyz Republic have considered the law bill, where President’s veto was overcome, and again it was send to the President.  But President hasn’t signed the bill, even though all the deadlines have passed.

R. Dyryldaev who was concerned with future situation around this law bill, have criticized President Akaev on the OSCE Conference in Warsaw, the Conference was held to discuss the issues concerning tortures, and he also have criticized Akaev on additional OSCE Conference on Torture Prevention on November 6-7, 2003.

At last now we know that the law on tortures was signed by the President on November 14.

We thank legislative branch Jogorku Kenesh, especially deputy A. Beknazarov for such contribution into development of human rights in Kyrgyz Republic.  We hope that government will find political will to implement this law, and also convention against tortures to its fullest extent.  We are confident that this law will be good start to fight tortures.

KCHR in its turn assures that it will conduct monitoring on implementation of this law and of convention against tortures.
